WITH CONGRESS HAVING LEFT WASHINGTON for the balance of August, and with many state legislatures having either recessed or adjourned, we are finding August to be a light news month, as is typical for this time of year. So, we are planning to follow our own customary practice of breaking, probably for the balance of the month. We’ll keep an eye on the news in case matters arise which require the attention of our readers. But do not expect to see Life Advocacy Briefing until our Sept. 6 edition or even one week beyond, depending on how the news stacks up closer to Labor Day.

 

War on Conscience Rights?

THE JUSTICE DEPT. HAS DROPPED A LAWSUIT brought by the Trump Administration against the University of Vermont Medical Center (UVMC), which allegedly forced a nurse to commit an abortion over her conscientious objection.

“In 2018 the UVMC had assigned the nurse to an abortion,” reports Doug Mainwaring for LifeSiteNews.com, “despite knowing she had been on a list of conscientious objectors for many years. She had been told,” explains the LSN writer, “she was going to help a patient who had suffered a miscarriage, and when she discovered that she was actually going to be participating in an elective abortion, was pressured to go through with aiding the procedure despite the presence of others who could have taken her place.

“During the course of its investigation,” writes Mr. Mainwaring, “the US Office of Civil Rights determined that UVMC maintains a policy that ‘admits to circumstances where UVMC can and will force staff – on pain of adverse action or discipline – to participate in abortions against their moral or religious objections.’”

The Justice Dept. concluded from its probe, notes Mr. Mainwaring, UVMC had committed “a clear violation of the nurse’s conscience rights, which are protected under federal law.” But in early August, he reports, “the Dept. of Justice abruptly ditched the case, as directed by the Biden Administration’s Health & Human Services (HHS) Secretary,” the notoriously pro-abortion Xavier Becerra.

Roger Severino, who was director of the Office of Civil Rights in the HHS Department during the Trump years, declared in response to the announcement, reports Mr. Mainwaring, “‘Such a politically motivated backstab means it’s open season on pro-life doctors and nurses.’” He also said, in a statement to Fox News, again quoted by LSN, the dropping of the lawsuit is a “‘dereliction of duty.’

“In a searing critique of the Biden Administration’s abandonment of the case published in National Review,” writes Mr. Mainwaring, “[Mr.] Severino explained that ‘Big abortion is desperate to eliminate conscience protections for medical professionals that have been in place for decades because it helps their bottom line to have more people complicit in their sordid business. And now with Pres. Biden and HHS Secy. Xavier Becerra in power,’” he wrote, quoted by LSN, “the abortion industry is getting its wish.’” In so many ways.

In the Courts

  • S. DISTRICT JUDGE SARAH EVAN BAKER HAS KNOCKED DOWN “several of Indiana’s laws restricting abortion,” reports Associated Press writer Tom Davies, though the judge also “upheld other state abortion limits” in a 2018 lawsuit by Whole Woman’s Health Alliance, seeking to overturn denial of a license to open an abortuary in South Bend. Among the statutes enjoined by the judge: Indiana’s telemedicine abortion ban and, notes Mr. Davies, “the prohibition on second-trimester abortions outside hospitals or surgery centers. [Judge] Barker also ruled against state laws requiring that women seeking abortions be told human life begins when the egg is fertilized and that a fetus might feel pain at or before 20 weeks.” Expect an appeal to the 7th Circuit Court of Appeals.

  • TEXAS-BASED U.S. DISTRICT JUDGE REED O’CONNOR “handed religious liberty advocates a major win,” reports Michael Foust for com, “by ruling that the Biden Administration cannot force Christian doctors and religious hospitals to perform abortions or gender transition procedures under ObamaCare. … Luke Goodrich, vice president and senior counsel at the Becket Fund for Religious Liberty, called the decision a ‘victory for compassion, conscience and common sense.’”

 

Thwarting the States’ Reform Campaigns

REP. JUDY CHU (D-CA), ALONG WITH 189 Co-SPONSORS, HAS FILED HR-3755, which they call the “Women’s Health Protection Act.” The measure, which is truly an abortion-cartel protection bill, has been assigned to the House Committee on Energy & Commerce.

Here are the provisions as outlined by Priests for Life national director Fr. Frank Pavone:

  • “Negate mandatory waiting periods before abortion.
  • Eliminate requirements for ultrasound prior to abortion.
  • Prohibit abortionists or staff from providing information about the developing baby, potential risks of abortion or the possibility of halting a chemical abortion.
  • Eliminate bans on telemedicine.
  • Repeal laws calling for abortion businesses to meet standards of other ambulatory surgery centers; requiring abortionists to have admitting privileges at nearby hospitals;
  • Eliminate bans on certain abortion procedures, including dismemberment abortion;
  • Eliminate bans on abortion after fetal viability based on ability to feel pain;
  • Prohibit abortionists or staff from asking the reason for the abortion – for instance, sex-selective abortion or abortion for Down syndrome;
  • Eliminate conscience protection rights for healthcare providers;
  • Eliminate the Sanctuary City designation in more than two dozen US cities that have declared themselves abortion-free zones.”

Another Twisted Federal Abortion Proposal

U.S. SEN. TAMMY DUCKWORTH (D-IL) HAS FILED S-1021, the so-called “Equal Access to Abortion Coverage in Health Insurance” bill, which has been referred to the Senate Committee on Health, Education, Labor & Pensions. We list her 28 co-sponsors below.

The bill purports to codify “abortion rights” in federal statutory law and declares: “All people should have access to abortion services regardless of actual or perceived race, color, ethnicity, language, ancestry, citizenship, immigration status, sex (including a sex stereotype; pregnancy, childbirth or a related medical condition; sexual orientation or gender identity; and sex characteristics), age, disability or sex work status or behavior.” (It is increasingly obvious that the current drive of the social Left is making our language and the language of our laws twisted and cumbersome in the extreme!)

Gender-bending gobbledygook aside, the proposal, reports Catherine Livingston PhD for Live Action, citing Sarah Parshall Perry in the Washington Times as source, “would require any federal healthcare providers to both offer abortion and pay for it” via tax funds. It would also, according to Mrs. Perry, “‘permit qualified health plans to use the Health Insurance Marketplace [ObamaCare] tax credit, which was designed to help low-income individuals afford health insurance. (Such use is currently prohibited by federal law.)’”

The so-called “EACH Act” is also under consideration in the House, where HR-2234 is sponsored by Rep. Barbara Lee (D-CA) along with 167 fellow Democrats as co-sponsors. It has been assigned to several committees in the House: Energy & Commerce, Ways & Means, Natural Resources, Armed Services, Veterans’ Affairs, Judiciary, Oversight & Reform and Foreign Affairs. The bill’s inclusion of massive subsidies to the abortion cartel was a principal reason for conservatives’ reconsideration motion, as it was one of the principal reasons for the earlier attempt to send the bill back to committee; we published that roll call in last week’s edition.
